1 a) These Terms and Conditions apply to users of the Melbourne Furniture website (www.melbourne furniture.com.au) and cover the usage of the website, purchase of goods, and related services.

1 b) By using the website or placing an order, you agree to these Terms and Conditions.

1 c) These terms and conditions are applicable to all customers, including those placing orders through Melbourne Furniture showrooms, social media channels, and by phone.

2 a) In these Terms and Conditions:

  • Agreement: Refers to these terms and conditions and all terms of any order placed through the website.
  • Customer: Refers to the person or legal entity identified in the website invoice or sales document.
  • Delivery Cost: Denotes the costs associated with delivery specified in an order.
  • Goods: Indicates the products listed in an order.
  • Intellectual Property: Covers all rights in patent, copyright, trade names, trademarks, logos, designs, and related intellectual property rights.
  • Material: Encompasses any information or images in any form stored on or used with the website.
  • Products: Refers to any items listed on the website.
  • Website: Denotes the internet site located at www.melbournesfurniture.com.au and operated by Melbourne Furniture.

2 b) Any reference in this Agreement to the singular includes the plural, to any gender includes all genders, and to any act or statute includes any Act or statute that supersedes, replaces, or modifies any earlier Act or statute. Paragraph headings are for reference purposes only, and all references to clauses are to clauses in this Agreement unless otherwise specified.

3 a) The website may contain links to other websites, provided for convenience and may not remain current or maintained. Melbourne Furniture is not responsible for the content or privacy practices of linked websites.

3 b) Users must ensure their access to or use of the website is legal and complies with applicable laws.

3 c) Users must take precautions to prevent exposure to viruses, malicious code, or other forms of interference that could damage computer systems. Melbourne Furniture is not responsible for any such damage.


  1. Pricing

4 a) All prices on the website are in Australian Dollars.

4 b) Prices listed include applicable taxes unless stated otherwise.

4 c) Prices displayed are subject to change without notice. Prices for items in an order are fixed once the order is confirmed. Subsequent price changes will not apply retroactively to confirmed orders.

4 d) Customers agree to pay the calculated delivery charges listed in the order confirmation.

4 e) Free shipping offers are at Melbourne Furniture's discretion. Additional charges may apply for delivery to remote areas.

4 f) Melbourne Furniture reserves the right to refuse a sale.



  1. Product Specifications

5 a) Features and specifications of products described or depicted on the website are subject to change without notice.

5 b) Weights and dimensions mentioned are approximate and based on individual fully assembled unpackaged products.


  1. Orders

6 a) Orders can be placed through the Melbourne Furniture website by filling the order form and clicking "confirm." Each order, once confirmed, represents a separate agreement.

6 b) Orders are considered received when Melbourne Furniture sends an order confirmation to the customer's nominated email address.

6 c) Melbourne Furniture primarily communicates via email. Customers are responsible for providing correct contact details and checking their nominated email regularly.

6 d) Melbourne Furniture reserves the right to not accept or cancel orders requesting commercial quantities of goods.

6 e) Melbourne Furniture may cancel orders at its discretion, including products sold on pre-sale.

6 f) Melbourne Furniture may charge a cancellation fee of $40 for orders canceled within 48 hours of the scheduled delivery date.

6 g) In the event of a canceled order, paid funds will be refunded promptly.

6 h) Melbourne Furniture reserves the right to alter product specifications without notice for continuous improvement. Such alterations do not entitle customers to return products or cancel orders.

6 i) Melbourne Furniture is not responsible for orders declined due to internet disruptions.

6 j) Melbourne Furniture will not hold stock in the warehouse for more than 8 weeks, subject to change based on delivery schedules.

6 k) Melbourne Furniture may charge a storage fee of $20 per week for orders with warehouse stock held at the customer's request.

6 l) Melbourne Furniture may re-allocate orders to future shipments if customers cannot accept delivery within the 8-week timeframe.


  1. Payment

7 a) Melbourne Furniture accepts Visa, Mastercard, and Swipe transactions.

7 b) Payment is processed upon order confirmation, including products listed as pre-sale.

7 c) Melbourne Furniture may contact customers for additional details or rescind transactions triggering internal suspect protocols.

7 d) Orders are dispatched only upon full payment received 3 business days before the delivery date.


  1. Delivery and Ownership of Goods

8 a) Melbourne Furniture strives for timely delivery. Delays due to shipping and other factors beyond control are possible. Melbourne Furniture is not liable for loss or damage due to such delays.

8 b) Dispatch dates, communicated via email, are estimates and subject to change with notice. Goods are not dispatched to PO box addresses.

8 c) Title and risk in goods pass to the customer upon delivery acceptance.

8 d) Written authority for delivery without a signature voids included insurance cover.

8 e) Customers must liaise for delivery arrangements once goods are dispatched. Melbourne Furniture provides information in good faith but does not guarantee accuracy.

8 f) Melbourne Furniture may refuse to pick up items delivered to incorrect addresses for redelivery.


  1. Conditions of Delivery

9 a) Melbourne Furniture deliveries To Melbourne metro only at different prices based on product size/weight/quantity and distance from our warehouse.

9 b) Melbourne Furniture offers FREE! delivery to customers on any of our products in the Casey area only, deliveries are sometimes one-man and may require customer assistance.

9 c) Safe access for a large truck maybe necessary. Customers must ensure their address accommodates delivery requirements. Melbourne Furniture is not liable for property damage due to lack of safe access.

9 d) Melbourne Furniture delivers to the front of homes. Interior placement is at the driver's discretion. Melbourne Furniture is not responsible for damages due to difficult access.

9 e) Inclement weather may cause delivery delays. Alternative delivery options' costs are the customer's responsibility.


  1. Faulty or Damaged Goods

10 a) Melbourne Furniture repairs or replaces damaged or faulty goods as per the standard warranty.

10 b) Faulty goods within 7 days post-delivery will be replaced, repaired, or refunded. Photographic evidence of damage is required for goods damaged on delivery.

10 c) Customer misuse or improper care voids warranty claims.

10 d) Melbourne Furniture determines faults or damages at its discretion.

10 e) Customers must respond to Melbourne Furniture's correspondence promptly for warranty claims to be valid.


  1. Refunds and Returns

11 a) Melbourne Furniture does not provide refunds, returns, or exchanges for wrong purchase decisions or change of mind unless covered under Clause 10.

11 b) Returns under these Terms and Conditions must be facilitated via email to zibi@melbournesfurniture.com.au.

11 c) Customers must follow Melbourne Furniture's staff directions for returns.

11 d) Customers are responsible for the safe return of items. Melbourne Furniture is not liable for lost items during transit.

11 e) Items must be returned in original condition; must be in original packaging and not used.

11 f) No returns are accepted for mattresses due to their nature.


  1. Warranties

12 a) Products are covered by a 12-month standard warranty. This warranty is in substitution for other terms, conditions, and warranties, and Melbourne Furniture's liability is limited as per these Terms and Conditions.

12 b) Melbourne Furniture reserves the right to refuse spare parts where stock is limited.

12 c) Certain legislation may imply warranties that cannot be excluded. Melbourne Furniture's liability under such legislation is limited to the provisions in these Terms and Conditions.


  1. Intellectual Property

13 a) All intellectual property on the website belongs to Melbourne Furniture. Unauthorised reproduction or distribution is prohibited.


  1. Indemnity

14 a) Users waive claims against Melbourne Furniture connected with the website usage.


  1. Liability

15 a) To the extent permitted by law, all conditions or warranties are excluded. Melbourne Furniture's liability is limited to the Terms and Conditions and related warranties. Melbourne Furniture is not liable for indirect or consequential losses.


  1. Privacy

16 a) Personal information is collected for marketing, product supply, improvement, and business expansion.

16 b) Melbourne Furniture protects privacy and does not sell, rent, or share personal information.

16 c) Customers can request access to their information by emailing zibi@melbournesfurniture.com.au.


  1. Security

17 a) Melbourne Furniture ensures data security using SSL certificates and security restrictions.


  1. General

18 a) Melbourne Furniture reserves the right to change the website and Terms and Conditions without notice.

18 b) Void provisions do not affect other provisions.

18 c) Failure to exercise a power or right does not waive it, and exercising a power or right does not preclude future exercise.
